General Terms and Conditions

Elyzium Digital Pvt Ltd Bridging Possibilities

1. Elyzium Digital Pvt Ltd shall not be responsible for any installation, commissioning or maintenance of any equipment or hardware unless supplied by Elyzium Digital Pvt Ltd.

2. Force Majeure: If, at any time, during the continuance of the contract, the performance in whole or in any part by either party of obligation under the agreement is prevented or delayed by reasons of any war, hostile acts of the enemy, civil commotion, subrogate, fire, floods, earthquakes, explosions, epidemics, strikes and quarantine restrictions (herein after referred to as eventualities) neither party shall, by reason of such eventualities be entitled to terminate this contract agreement nor shall either party have any claim for damages against the other in respect of such non- performance or delay in performance. Performance of the contract agreement shall, however be resumed as soon as practicable after such eventuality has come to an end or ceased to exist.

3. Customer to be solely responsible for the content of the data and materials transmitted on network. No objectionable, obscene, unauthorized or any content or messages infringing IPRs and cyber laws, in any form or inconsistent with the laws, are carried in network.

4. Elyzium Digital Pvt Ltd can change or amend the regulatory terms and conditions at any time as and when necessary to comply with any statutory, legal or regulatory requirements.

5. Customer to comply with all applicable laws and regulations including, the provisions of the Telegraph Act 1885 etc.

6. Elyzium Digital Pvt Ltd to have the right to withdraw services if such an action is necessary as per directive issued by the government body, regulatory authority or their authorized agencies.

7. Customer to provide necessary facilities to Elyzium Digital Pvt Ltd or any other Government Agencies to counteract espionage, subversive act, sabotage or any other unlawful activity.

8. Elyzium Digital Pvt Ltd is entitled to, without any liability, refuse, limit, suspend, vary, disconnect and or interrupt the service, in whole or in part, at any time, for any reason and/or due to various factors including but not limited to:
a. Government’s rules, regulations, orders;
b. Combat potentiel fraud, sabotage, etc.
c. Force-Majeure circumstances.
Elyzium Digital Pvt Ltd shall have the right to inspect CPE for using the network services, after giving the notice or as without notice, per directive received from regulatory.

Privacy Policy

The Elyzium Digital Pvt Ltd collects personal information when customer registers for the purpose of using Elyzium Digital Pvt Ltd solutions , when the Customer registers to visit the Elyzium Digital Pvt Ltd, web pages. The Elyzium Digital Pvt Ltd may mutually use personal information that is obtained from business partners or other Companies. The Elyzium Digital Pvt Ltd has the right to deliver the Customer’s information to its business associates, franchisees without referring the same to the Customer. When the Customer registers with the Elyzium Digital Pvt Ltd, the Elyzium Digital Pvt Ltd receives information about the Customer’s name, telephone number, e-mail address, P.O. address, birth date, gender, occupation, industry, and personal interests and any other ID related to the specific service Customer applies for. When the Customer registers with the Company and sign in to Company’s services, the Customer acquires a status of valued one. The Company collects information about Customer’s transactions with the Company and its business partners included. Information is collected about Customer’s use of the demanded services. The Company can use this information to customize its services as per the required solution..

Refund & Cancellation Policy

In case of service being provisioned due to inability of Elyzium Digital Pvt Ltd, full refund will be initiated to the customer.

In case of service being provisioned due to inability of customer, then OTC will be deducted and remaining balance will be refunded back to the customer.

Also any damage to the hardware installed at customer premises will be charged extra.

Any cancellation due to service reasons has to be communicated to the regional local team of the respective location.

Any refund, if applicable, will be paid to the customer within 30 working days from the receipt of cancellation confirmation.

Account termination will be done on receipt of CPE by the Elyzium Digital Pvt Ltd in working condition.
